Terms and Conditions

The embodied carbon repository (Carbon Data) is a joint collaboration between Construction Information Limited, trading as Masterspec (Masterspec), and BRANZ Limited (BRANZ) intended to empower you to make environmentally responsible decisions regarding your building designs and material selections. The Carbon Data is made available to you in accordance with Masterspec's general terms and BRANZ' terms of use. By downloading or using the Carbon Data, you confirm you have read and agree to Masterspec's general terms and BRANZ' terms of use, and agree that:

• if you share or reproduce any part of the Carbon Data you will:
  • give attribution to Masterspec and BRANZ by clearly and prominently referring to both Masterspec and BRANZ as the "original collaborators";
  • prominently provide a clear hyperlink or URL to the original source of the Carbon Data, found at neco2.co.nz;
  • not in any way indicate (including by implication) to any person that Masterspec or BRANZ endorses or sponsors you, your business, or your use of the Carbon Data;
  • prominently indicate that any person who downloads or uses the Carbon Data is subject to these terms and require any additional users to expressly agree to these terms;
  • retain indication of any previous changes; and
  • if changes are made to the Carbon Data, prominently identify where such changes have been made;
• you will use the Carbon Data in a fair and reasonable manner, and will not redistribute it.
• you will not charge any additional fee or require any additional consideration from any person for their access to, or use of, the Carbon Data; and
• you will indemnify Masterspec and BRANZ against any direct or indirect loss incurred as a result of any party you share the Carbon Data with accessing or using the Carbon Data.

You also agree and understand that:

• your use of the Carbon Data is at your own risk and neither Masterspec nor BRANZ makes any representations or warranties that the Carbon Data is error-free, accurate, or up to date; and
• neither Masterspec nor BRANZ will be liable to you in respect of any loss arising from your use of, or access to, the Carbon Data. Notwithstanding this, to the extent any liability does arise, Masterspec and BRANZ's total aggregate liability to you in respect of the Carbon Data (if any) is limited to any fees paid by you to Masterspec in the 12 months prior to the event giving rise to liability occurring.
